Acceptable Use Policy

Prohibited Uses

You may use the Service only for lawful purposes and in accordance with this AUP and the Terms of Service. You must not use the Service or any Output:

• In any way that violates, or promotes, facilitates, or contributes to violation of, any applicable federal, state, local, or international law, ordinance, or regulation (collectively, "Laws").
• In any way that is inconsistent with this AUP, including to submit Input or generate Output prohibited in the Content Standards section of this AUP.
• For exploiting, harming, or attempting to exploit or harm, children in any way, whether or not prohibited by Law, including by:
  • distributing or promoting child sexual abuse material;
  • facilitating or promoting trafficking, sextortion, grooming, or abuse of children;
  • exposing children to sexual or other inappropriate content;
  • collecting children's personal information; or
  • using children's personal information.
• For engaging in, promoting, or facilitating human trafficking (including sex trafficking) or unlawful sexual solicitation (including illegal prostitution), exploitation, or violence.
• For engaging in, promoting, or facilitating nonconsensual sexual content, including but not limited to:
  • nonconsensual deepfake pornography;
  • sexual violence, coercion, or abuse; or
  • any other form of nonconsensual or exploitative material.
• To create, generate, or simulate any sexual or non-sexual Output that depicts, resembles, or appears to resemble a real person—whether through physical likeness, voice, name, personality traits, behavioral patterns, or any other identifying characteristics—without that person's prior, documented, informed, and voluntary written consent. This prohibition applies regardless of whether the resemblance is partial, implied, fictionalized, or presented as parody.
• To deceive, defraud, mislead, misinform, or disinform others, including to:
  • impersonate any person;
  • represent, or otherwise deceive or mislead others to think, that Outputs are human-generated;
  • create promotional, commercial, or social media content intended to mislead viewers into believing any Output is a real person, including through reposting on fan sites, dating platforms, or advertisement materials;
  • engage in academic dishonesty or plagiarism;
  • distribute spam; or
  • distribute or promote misinformation or disinformation.
• To engage in, promote, facilitate, incite, or contribute to harassment, discrimination, violence, terrorism, abuse, bullying, threats, intimidation, or hateful behavior, content, or speech.
• In any way that you know or should know infringes or is likely to infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any person.
• In any way that compromises or violates the legal rights (including the rights of publicity and privacy) of any person, including by:
  • accessing, collecting, soliciting, processing, disclosing, or sharing personal information in any manner that does not strictly comply with Laws and any disclosures;
  • conducting unlawful monitoring, tracking, or surveillance of individuals; or
  • using or distributing digital replicas in any manner that does not strictly comply with Laws, including, without limitation, all disclosure, consent, and authorization requirements imposed by Laws.
• To generate or provide legal, financial, health, medical, tax, or other professional advice, decisions, or recommendations.
• To develop, use, operate, produce, market, exchange, or distribute weapons, explosives, or any dangerous, illegal, regulated, or controlled substances, products, or materials.
• To engage in or facilitate political campaigning, lobbying, or the disruption or interference with any election process, including generating campaign materials or political advertisements.
• To advertise, promote, or facilitate the sale of any goods or services without our prior written authorization.
• To prompt or generate any content that encourages, promotes, or suggests dangerous, self-harming, reckless, or otherwise unsafe behavior by users or third parties, whether explicitly or implicitly, and regardless of whether intended as roleplay or fantasy.
• In a manner that violates or attempts to circumvent applicable card network rules, including the Visa and Mastercard Standards. This includes strict compliance with all requirements relating to age verification, consent, record-keeping, and restrictions on sexually explicit content. Users must not prompt, generate, or share any content or scenarios that could cause KalonAI to be non-compliant with these standards.

Additionally, you must not:

• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service or any connected or related computer, software, firmware, hardware, device, data, database, system, or network.
• Violate, attempt to violate, or knowingly facilitate the violation of the security, integrity, or availability of the Service or any connected or related computer, software, firmware, hardware, device, data, database, system, or network.
• Introduce or distribute to the Service or use the Service to introduce or distribute any viruses, Trojan horses, backdoors, malware, worms, logic bombs, malicious code, or other software, device, technology, or material that is malicious or technologically harmful.
• Circumvent or interfere with features, functionality, filters, or safeguards of the Service that are intended to limit or mitigate violations of Laws or this AUP or other harms resulting from use of the Service, including attempts to bypass AI filters or moderation systems.
• Attempt to bypass, disable, or manipulate any content filters or safety systems, including by crafting prompts designed to evade safety restrictions, rephrase prohibited content, or induce the Service to violate this AUP. You are responsible for all Input and must not attempt to disguise, obscure, or indirectly reintroduce prohibited content through coded language, substitutions, or fictional framing intended to circumvent restrictions.
• Prompt the Service to perform in a way that violates this AUP, the Terms of Service, or any Law.
• Otherwise attempt to interfere with the proper working of the Service.

Content Restrictions and Standards

You must not use the Service to submit, upload, or input any Input, or generate or produce any Output, that:

• Violates any applicable Laws or promotes, facilitates, or assists conduct that would violate any applicable Laws.
• Is inconsistent with this AUP, including the Prohibited Uses section of this AUP.
• Promotes, describes, or depicts exploitation, abuse, or harm to a child, including:
  • child sexual abuse material;
  • content impersonating or intended to impersonate a child; and
  • any scenario involving non-adult participants in sexual situations, whether real, fictional, or AI-generated.
• Include, promote, or normalize nonconsensual sexual content, whether real or simulated, including but not limited to rape, sexual assault, coercion, abuse, incest, necrophilia, or bestiality.
• Depict or promote extreme or violent sexual acts, or gratuitous or extreme violence or gore—whether sexual or non-sexual in nature—including torture, mutilation, or death.
• Includes or generates deepfake or AI-generated sexual content involving real individuals, particularly where that content is nonconsensual or violates applicable Laws or the consent and impersonation restrictions in this AUP.
• Depicts or implies any real person, including but not limited to celebrities, influencers, public figures, or private individuals, in any sexual, violent, abusive, or otherwise inappropriate context—whether through likeness, implied identity, or simulation.
• Is obscene under applicable Laws.
• Is deceptive, fraudulent, misleading, or otherwise intended or likely to misinform or disinform others, including:
  • defamatory content;
  • fake online reviews, comments, or other engagement;
  • deepfakes presented as authentic;
  • spam; and
  • false or misleading information related to health, medical advice, public safety, democratic processes (including elections and referenda), or legal rights, where such content could reasonably cause harm or materially mislead users.
• Includes, describes, or promotes harassment, discrimination, violence, terrorism, abuse, bullying, threats, intimidation, or hateful behavior, content, or speech.
• You know or should know infringes or is likely to infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any person.
• Violates the legal rights (including the rights of publicity and privacy) of any person or contains any material that could give rise to any civil or criminal liability under Law, including, without limitation, digital replicas created or generated in any manner that does not strictly comply with Laws and all consent and authorization requirements imposed by Laws.
• Simulates emotional manipulation (e.g., AI "breakups"), threatens emotional withdrawal, or encourages dependency in a manner that could reasonably cause distress, psychological harm, or emotional instability to users.
• Intentionally causes harassment, intimidation, or distress to another person.
• Impersonates any person, or misrepresents your identity or affiliation with any person.
• Gives the impression that it emanates from or is endorsed by us or any person, if this is not the case.
• Includes any viruses, Trojan horses, backdoors, malware, worms, logic bombs, malicious code, or other technology or material that is malicious or technologically harmful.

Disclosures and Consents

• You must disclose your use of the Service and obtain written consent to use the Service as required by, and in accordance with, Laws.
• You must disclose that any deepfake Output has been artificially generated or manipulated.
• You must clearly label any Output that depicts a synthetic individual or digital replica as artificial, fictional, or computer-generated where failure to do so may reasonably mislead viewers or imply endorsement by a real person.
• You must not present AI-generated characters or responses as real people. Any content that could reasonably mislead users into believing a synthetic persona is a real person must be clearly labeled as fictional, artificial, or computer-generated.

We may use automated tools, including AI-based systems, to assist in moderation and enforcement of this AUP. Where automation contributes to a decision affecting you, our Complaints Policy and Appeals Policy explain how you will be notified and how you can request human review.

Fictional Fantasy and Roleplay Disclaimer

The Service permits users to engage with fictional characters or AI-generated personas in roleplay or fantasy scenarios, including those involving taboo or extreme themes, so long as those scenarios:

• Involve only fictional adults and do not involve or imply minors or non-adult participants;
• Do not depict, simulate, or promote nonconsensual acts;
• Do not encourage or normalize unlawful conduct; and
• Are clearly fictional and remain within the bounds of fantasy.

All content must comply with applicable Laws, card network rules, and this AUP.

Monitoring and Enforcement

We may monitor your use of the Service to evaluate your compliance with this AUP and to investigate any suspected or reported violation by you. Any violation of this AUP by you constitutes a material breach of the Terms of Service. In addition to our rights under the Terms of Service, if we determine that you have violated this AUP, we may:

• Terminate or suspend your access to all or part of the Service.
• Take appropriate legal action, including without limitation, referral to law enforcement or any authority, for any illegal or unauthorized use of the Service.
• Report any violations of this AUP relating to exploitation or abuse of children, including child sexual abuse material, to the National Center of Missing & Exploited Children (NCMEC) and other relevant authorities and organizations.

We also reserve the right to restrict or remove any content, Input, Output, or user access that we determine, in our sole discretion, poses a risk to the safety, integrity, legal compliance, or proper functioning of the Service—even if not expressly prohibited by this AUP. In addition, we reserve the right to block or remove content that, in our sole judgment, exceeds acceptable fantasy boundaries or may result in regulatory or legal risk.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone who accesses or uses the Service. You hereby waive and shall indemnify us and our affiliates, licensees, and service providers against any claims resulting from any action taken by any of the foregoing parties during, or taken as a consequence of, investigations by either those parties or law enforcement or other authorities.

This AUP should be read together with our Complaints Policy and Appeals Policy, which describe how to challenge our decisions and escalate complaints to regulators in the EU and UK.

Users who believe their account or content was restricted in error may appeal under our Appeals Policy.

Modifications

You acknowledge that we have the right, in our sole discretion, to modify this AUP on one or more occasions, and that modified terms become effective on posting. You are responsible for reviewing and becoming familiar with any modifications. Your continued use of the Service after the effective date of the modifications will be deemed acceptance of the modified terms.
